Medical Power of Attorney

What is a Medical Power of Attorney?

Medical Power of Attorney is a legal document in which you list who you would want to make medical decisions on your behalf if you are unable.  You are considered the principal and the person you designate to make decisions on your behalf is called the agent.  The agent is to make decisions based on their knowledge and familiarity with the principal. 

What rights are under a Medical Power of Attorney?

The principal has the right to limit the agent’s decision-making authority within the Medical Power of Attorney document or spell out their specific wishes and desires.  The document can have an expiration date for the Agent and can list back up agents as well. We generally also draft a HIPAA Release to mirror the Medical Power of Attorney document. 

 

When is the Medical Power of Attorney Document Effective?

The document can become effective immediately if so desired or at a later date. 

How long is a Medical Power of Attorney Document Good For?

We can make the document last forever or for a limited period of time based off a date you provide.  The document can be good for life so long as the law do not change. We do recommend updating the Medical Power of Attorney document at least every ten years. 

 

Who can Witness a Medical Power of Attorney?

The document cannot be witnessed by family members or health care providers. 

It must be signed by two disinterested witnesses or a notary.

What do I need to get a Medical Power of Attorney Document?
