What is a Declaration of Guardian?

Declaration of Guardian is a legal document where you, the Principal, list a person or people you trust to act as your agent/guardian if you are unable to make decisions on your own. 


What is in a Declaration of Guardian?

Within the Declaration of Guardian document, there are two areas where you will list a guardian: 1- Guardian of your Estate and 2 - Guardian of your Person as per the Texas Estates Code

Is Declaration of Guardian the Same as a Power of Attorney and Medical Power of Attorney?

This form is very similar to a Power of Attorney document and Medical Power of Attorney document. This form allows you to designate who will make decisions concerning your person's well being and your financial well being when you are unable to make decisions on your own.


When is a Declaration of Guardian Effective?

This document becomes effective when you become incapacitated (unable to legally make decisions on your own).
